Kit beta terms

1. What you are installing

Kit is beta software: a memory-backed AI collaborator that runs as a private stack on your own Mac, by invite. Beta means it is genuinely useful and genuinely unfinished; things will occasionally break, change, or ask for patience. It is offered by Pondo Consulting (Pty) Ltd, Cape Town, South Africa, reachable at kit@kit-project.com.

2. Your license to use it

You get a personal, non-transferable, revocable license to run the Kit app and its local stack for your own use during the beta. Please don't redistribute the app, resell it, or pass your invite along without asking us; the beta is small on purpose. Everything your Kit stores belongs to you, not us; the Kit software, name, and branding remain ours.

3. The software is ours; your memories are yours

Kit ships with its source code inside the app, so you can see exactly what runs on your machine. That openness is a promise about transparency, not a transfer of rights: the code, the prompts, and the way Kit thinks and dreams remain the property of Pondo Consulting (Pty) Ltd. You may not copy them, sell them, build competing products from them, or use them to train AI systems. Everything your Kit remembers is yours alone, and the export exists so that never depends on us.

4. Where your data lives, and exactly what leaves your Mac

Your Kit's memory lives in a database on your machine. We run no server that holds your memories and we cannot read them. Four things do leave your Mac, and this list is intended to be complete:

• Model calls. Kit thinks with the model provider you connect, under your own API key. Content sent to that provider (including memories retrieved into context) is governed by that provider's terms, not these.
• Setup email. The email address you enter at setup is used to send you your welcome mail and, rarely, beta-critical notices.
• Update checks. The app checks kit-project.com for new versions. This carries version information, not memory content.
• Beta monitoring. While Kit is in beta, your Kit reports daily: your name and setup email, its name, which versions it is running, which connected surfaces it manages, which runtime it is on, and whether its background services are up (states and restart counts). If an update fails, it also sends the error lines from that update run with sign-in details stripped, so we can fix it without asking you to dig out logs; if a dream cycle or a background service crashes, it sends when that happened and the crash's own error lines, filtered the same way. It also sends two numbers about the nightly dream cycle: how many days since one last finished, and how many attempts have failed in a row. When one of your Kit's own health checks is unhappy, it sends which check, the one line it says about itself, and the fix it suggests, so we can act on the actual fault instead of a number; those lines are your Kit describing its own machinery, counts, timings, states and the names of its own parts. Never memories, messages, files, or anything you or your Kit work on. Set KIT_TELEMETRY=0 in your Kit's .env to turn all of it off, or ask us to remove you and we delete the record.

There is no analytics or telemetry beyond the above. If that ever changes, these terms change first, visibly, with a new version date.

5. Beta expectations, backups included

Treat the beta like a sharp new tool: powerful, improving weekly, and not yet the place for your only copy of anything irreplaceable. Kit includes export; use it. We work hard on durability (your Kit audits its own recall nightly), but during a beta you should assume a bad week is possible.

6. No warranty, limited liability

The beta is provided as is, without warranties of any kind, to the maximum extent the law allows. To the same extent, our total liability arising from your use of the beta is limited to the amount you paid for it, which during the beta is nothing. Nothing in these terms limits liability that cannot lawfully be limited.

7. Ending things

You can stop any time: quit the app and remove the stack; the uninstaller removes what was installed. Your data remains yours before, during, and after; export it whenever you like. We can end beta access if these terms are broken or the beta winds down, in which case your local data still remains yours.

8. Changes

These terms are versioned by date. If a change is material, the app will ask you to agree again before continuing; quiet edits to substance are not a thing we do, on principle and in product.

9. The boring but necessary line

These terms are governed by the laws of South Africa. If a part of them is found unenforceable, the rest stands.
